Terms and Conditions

These Terms and Conditions (“Terms”) apply to all purchases, services, and interactions with Josie Kleinitz Photography & Fine Art ("I", “we”, “us”, “our”). By accessing our website, purchasing products, or engaging with our services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our website or services.

1. General

By purchasing any items or services from Josie Kleinitz Photography & Fine Art, you agree to the Terms and Conditions outlined here. We reserve the right to update, change, or modify these Terms at any time. Any changes will be posted on this page and will become effective immediately.

2. Pricing and Payments

Pricing: All prices listed are inclusive of tax and exclusive of shipping costs, unless otherwise stated.

Shipping Costs: Shipping costs will be calculated at checkout and are the responsibility of the customer. Shipping costs will not be refunded in case of returns, cancellations, or exchanges.

Payments: We accept payments through major credit cards or PayPal. All payments must be processed and cleared in full before your order is shipped.

3. Products and Services

Artworks: Our artworks are original fine art prints, digital downloads, and photographic services. Products will be described and presented as accurately as possible on the website. However, slight variations may occur due to differences in screen settings or photographic lighting.

Custom Work: For custom projects, the customer agrees to provide all necessary details and requirements before the work begins. Custom works are non-refundable once the project has commenced.

4. Return, Refund, and Exchange Policy

Credits and Exchanges

If you are not satisfied with your product, you have 30 days from the date you receive your artwork to request a return or exchange.

Please note that:

• The item must be returned in its original condition, with all packaging intact.

• All returns and exchanges must be insured for their full value and sent via a trackable and prepaid shipping method.

• You are responsible for all return shipping costs, including any customs duties, taxes, or levies.

Store Credit: If you opt for a credit note instead of a refund, it will be in the form of store credit, valid for 6 months from the issue date.

Refunds

Refunds will not be processed beyond the 30-day return period.

Refunds are not applicable to:

• Digital downloads.

• Shipping fees, as these are non-refundable.

• Discounted or sale items.

• Items damaged due to improper handling by the customer.

Order Cancellation 

Orders can be cancelled within 24 hours of purchase for a full refund, provided the order has not yet been processed or shipped. To request a cancellation, please contact us as soon as possible.

Once the order has been processed or shipped, cancellations will not be accepted. If you wish to return an item after this point, please refer to our Returns & Exchanges policy.

Damaged Items in Transit

If an item is damaged in transit, please contact us within 5 business days of receiving your product to initiate a claim.

Manufacturing Faults

If a product has a manufacturing defect, we will either replace or repair it at our discretion.

Lost or Missing Orders

Once an order has been dispatched, Josie Kleinitz Photography & Fine Art is not responsible for any delays, damages, or losses caused by the shipping carrier. However, we will assist you in tracking the shipment if it goes missing. Please ensure that the delivery address you provide is correct and secure.

If your order goes missing, please contact us within 30 days of the shipping date. We will work with the carrier to locate the package, but if the item is confirmed as lost, a replacement or refund will be issued at our discretion, subject to the outcome of the carrier’s investigation.

5. Digital Downloads

Non-Refundable: Digital downloads are non-refundable due to the nature of the product.

By purchasing digital downloads, you agree to use them for personal, non-commercial use unless otherwise stated.

6. Photography Services

Photography Sessions: All photography services are subject to a signed agreement outlining specific deliverables and pricing.

Reshoots: If you are unhappy with the results of a photoshoot, a reshoot may be arranged at additional cost. We do not offer free reshoots unless extenuating circumstances apply.

7. Intellectual Property

All photographs, artworks, and content on the website are owned by Josie Kleinitz Photography & Fine Art and are protected by copyright laws. You may not reproduce, distribute, or alter any of the content without written permission.

Licensing: If you wish to use any content for commercial purposes, please contact us for licensing details.

8. Force Majeure

We are not liable for any delay or failure to perform our obligations due to circumstances beyond our control, including natural disasters, strikes, or government actions. We will make reasonable efforts to fulfill our obligations as soon as possible.

Limitation of Liability

To the fullest extent allowed by law, Josie Kleinitz Photography & Fine Art is not responsible for any indirect, incidental, or consequential damages arising from the use of our products or services.

Our liability is limited to the total amount you paid for the specific product or service.

11. Customer Responsibilities

It is your responsibility to provide accurate information when placing an order. Any delays or issues arising from incorrect details provided by the customer are not the responsibility of Josie Kleinitz Photography & Fine Art.

12. Product Availability and Substitution

Out of Stock: If a product becomes unavailable, we will notify you promptly. In such cases, we may offer a similar product as a substitute, or issue a refund if no suitable alternative is available.

13. Care Instructions

Please follow all care instructions provided with your purchase to ensure the longevity and preservation of your fine art prints or photographic works. Improper care or handling may void any warranties or returns.
